Terms & Conditions

Please read these terms and conditions carefully before using "War Plane: Mission Rescue" (referred to as the "Game"). Your access to and use of the Game is conditioned on your acceptance of and compliance with these terms. By accessing or using the Game, you agree to be bound by these terms. If you disagree with any part of the terms, then you may not access the Game.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Game for your personal, non-commercial purposes, subject to these terms and conditions.

This license does not allow you to:

• Modify, adapt, translate, or create derivative works based upon the Game;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game;
• Remove, alter, or obscure any copyright, trademark, or other proprietary rights notice on or in the Game;
• Use the Game for any purpose other than its intended purpose;
• Rent, lease, loan, sublicense, distribute, or otherwise transfer the Game to any third party;
• Use the Game in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by HyperGames Studio at any time. Upon terminating your access to the Game, you must destroy any downloaded materials in your possession, whether in electronic or printed format.

All rights not expressly granted to you herein are reserved by HyperGames Studio.

2. Intellectual Property

The Game and its original content, features, and functionality are and will remain the exclusive property of HyperGames Studio. The Game is protected by copyright, trademark, and other laws of US and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of HyperGames Studio. All other trademarks not owned by HyperGames Studio that appear in the Game are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by HyperGames Studio.

You agree not to reproduce, distribute, modify, or create derivative works based on, publicly display, publicly perform, or otherwise use the Game, except as expressly permitted by these terms or with the prior written consent of HyperGames Studio.

3. User Accounts

To access certain features of the Game, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or password.

If you believe that your account has been compromised or if there is any unauthorized use of your account, you agree to notify HyperGames Studio immediately.

HyperGames Studio reserves the right to suspend or terminate your account at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these terms.

4. Limitation of Liability

In no event shall HyperGames Studio, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Game.

HyperGames Studio shall not be liable for any damages, liabilities, losses, or expenses arising from:

• Any errors, mistakes, or inaccuracies of content;
• Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the Game;
• Any unauthorized access to or use of our servers and/or any personal information stored therein;
• Any interruption or cessation of transmission to or from the Game;
• Any bugs, viruses, Trojan horses, or the like which may be transmitted to or through the Game by any third party; and/or
• Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the Game.

These limitations of liability shall apply to the fullest extent permitted by law, whether in contract, tort (including negligence), or otherwise, even if HyperGames Studio has been advised of the possibility of such damages.

5. Governing Law

These terms shall be governed and construed in accordance with the laws of US, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these terms, including the validity, interpretation, or enforceability thereof, shall be resolved exclusively by the state and federal courts located in US.

Our failure to enforce any right or provision of these terms will not be considered a waiver of those rights. If any provision of these terms is held to be invalid or unenforceable by a court, the remaining provisions of these terms will remain in effect.

6. Changes

We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the Game after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Game.
